For Hylyght bv (hereinafter referred to as "HYLYGHT", "we" or "us") your privacy and that of your customers is essential. This privacy statement (hereafter referred to as "Privacy Statement") applies to, among other things, (i) our websites www.hylyght.com and www.app.hylyght.com (hereafter referred to as “Website”) and (ii) all relations between HYLYGHT and its customers and partners.

HYLYGHT wants to emphasize that it always tries to act in accordance with the GDPR legislation. This Privacy Statement contains, among other things, information about the personal data that HYLYGHT collects, as well as about the way in which HYLYGHT uses and processes this personal data. Visiting the Website, creating an account, and creating a demo account to use the demo of HYLYGHT implies your explicit approval (by means of communication of your personal data or opt-in) of the Privacy Statement and thus the way we collect, use and process your personal data. Types of personal data

HYLYGHT can collect and process the following data about users: name, first name, organization, address, e-mail address, telephone number (fixed / mobile), user name, password. HYLYGHT can collect and process the following data about athletes: name, first name, gender, date of birth and results of the tests and questionnaires used. HYLYGHT also automatically collects anonymous information regarding the use you make of the Website and the services of HYLYGHT via the Platform and/or the App. HYLYGHT will, for example, automatically log which parts you visit from the Website, the Platform and/or the App, which web browser you use, which website you visited when you got access to the Website, as well as your IP address. . We cannot identify you on the basis of this data, but it allows HYLYGHT to compile statistics regarding the use of the Website, the Platform and/or the App, as well as to send more targeted communication.

Ways of collecting personal data

The data of the athletes are collected at resp. in the context of: • Taking a test • Verification of the identity of an athlete • Downloading a report for the athlete as a result of a test • Reporting on the athlete(s) within the organization of the user • The data of the athletes collected by HYLYGHT are provided by one or more of the users of your organization under the responsibility of the Account Admin.

Use of personal data

HYLYGHT can use your user data for: • The creation of a (demo-) account and the confirmation thereof • Providing the services of HYLYGHT through the Platform and/or the App • The execution of an agreement with HYLYGHT • Providing support • Sending targeted information and updates • Sending invoices and the collection of payments • Optimizing the quality, management and content of the Website, the Platform and/or the App • Statistical purposes • Carrying out customer satisfaction surveys and other surveys

HYLYGHT can use the data of the athletes for: • Providing the services of HYLYGHT through the Platform and/or the App • The execution of an agreement with HYLYGHT • Optimizing the quality, management and content of the Platform and/or the App • Statistical purposes & scientific research • Conducting surveys

Disclosure of personal data to third parties

HYLYGHT will not disclose your personal information to third parties unless it is necessary for the provision of the services of HYLYGHT and the optimization thereof (such as but not limited to maintenance works, payment processing, database management). If it is necessary for HYLYGHT to disclose your personal information to third parties in this context, the third party in question is obliged to use your personal data in accordance with the provisions of this Privacy Statement. Notwithstanding the foregoing, it is possible that HYLYGHT may disclose your personal data to the competent authorities (i) if HYLYGHT is obliged to do so by law or in the context of juridical or future court proceedings and (ii) for indemnification and defense of our rights. In all other cases HYLYGHT will not pass on your personal data to third parties, unless it has (i) obtained your permission and (ii) has concluded a data processing agreement with the third party concerned, which contains the necessary guarantees regarding confidentiality and privacy your personal data.

Storage of personal data

Unless a longer retention period is required or justified (i) by law or (ii) by compliance with another legal obligation, HYLYGHT will only keep your personal data for the period necessary for the achievement and fulfillment of the goals, such as described in the Privacy Statement under 'use of personal data'.

Your privacy rights

If you wish to appeal to your privacy rights, as set out below, please contact us via : • Right to access the personal data that HYLYGHT may have about you; • Right to rectification, completion or update of your personal data; • Right to delete your personal data ('right to be forgotten'); • Right to a limitation of the processing of your personal data; • Right to transfer your personal data; • Right of objection / opposition to the processing of your personal data. Protection of personal data

HYLYGHT is committing to take reasonable, physical, technological and organizational precautions in order to prevent (i) unauthorized access to your personal data, as well as (ii) loss, misuse or alteration of your personal data. HYLYGHT will store all personal data it has collected in the cloud (Amazon Web Services). Notwithstanding the security policy of HYLYGHT, the controls it carries out and the actions it imposes in this context, an infallible level of security cannot be guaranteed. No method of transfer or retransmission via the Internet nor any method of electronic storage is 100% secure, so HYLYGHT cannot guarantee absolute security in this context. Finally, the security of your (demo) account will also depend on the confidentiality of your password to gain access to the Platform and/or the App. HYLYGHT will never ask for your password, so you are not obliged to communicate this yourself. If you have nevertheless communicated your password to a third party - for example because this third party has suggested to offer additional services - this third party will gain access to your (demo) account and your personal data via your password. In that case you are personally responsible for the actions that are taken by the use made of your (demo) account. HYLYGHT strongly advises you to immediately change your password and contact us in case you assume that someone has gained access to your (demo) account.

Cross-border processing of personal data

Any transfer of personal data outside the European Economic Area (EEA) to a recipient who is domiciled or established in a country that is not covered by an adequacy decision, issued by the European Commission, will be governed by provisions of a data transfer agreement, which includes (i) the standard contractual clauses, as stipulated in the 'Decision of the European Commission of 5 February 2010 (Decision 2010/87 / EC)' and the Annex to the COMMISSION IMPLEMENTING DECISION on standard contractual clauses for the transfer of personal data to third countries pursuant to Regulation (EU) 2016/679, or (ii) any other mechanism under the privacy legislation or any other regulation concerning the processing of personal data.
